On Wednesday, December 2, 2015, a circuit judge of DuPage County, Illinois dismissed the complaint filed by David Gibbs III against the Institute.

The Institute asked the Court to dismiss the complaint because it failed to state facts necessary to support the claims made against the Institute and its directors. Rather than defend the existing complaint, plaintiffs’ lawyers asked if they could file a new complaint. The judge gave permission for the plaintiffs to file an amended complaint by January 6, 2016.
